MT case at Hon PCAT, New Delhi: The case posted to 29^thFeb: ’12 for hearing.

Notional date of promotion for the SDEs promoted in 2004 under LDCE quota: Hon High Court at Ernakulam today given judgment in favour of extending notional date of promotion w.e.f 23.01.2002 for the SDEs promoted in the LDCE quota in 2004 with similar benefits extended by Hon CAT, Banglore (for the applicants). The judgment has to be implemented in 2 months time which will be subject to the outcome of the RA pending at Hon High Court of Karnataka at Banglore.

SDE to DE promotion: Status of various Court cases delaying our promotions to more than 2000 DE vacancies further denying the promotion of minimum 2000 JTOs to SDE cadre in the resultant vacancies ---

a) Rule 206 related cases on fixation of seniority of SDEs in list No 1 to 5 — The contempt petition against CMD/BSNL at Hon CAT, Chandigargh bench came up on 13.01.2012 and given 4 weeks time. The contempt petition against CMD/BSNL at Hon CAT, Gwalior bench came up on 16.01.2012 and given 4 weeks time. The contempt petition against CMD/BSNL at Hon CAT, Jaipur bench came up on 18.01.2012 and will be posted again in February. All these judgements are in favour of seniority as per para 206, based on qualifying year basis. The SLP filed by BSNL against the judgement of Hon CAT, Jaipur bench upheld by the Hon Rajasthan High Court is coming up in the Hon Supreme Court for admission on 27.01.2012.

b) Hon CAT, Jabalpur Bench stayed convening of DPC forAdhoc DE promotion till the next date of hearing, ie 26.03.2012.

c) The review application filed by BSNL in the Hon Mumbai High Court against the quashing of seniority lists 6 & 7 is coming up for admission on 27.01.2012. BSNL filed SLP also in the Hon Supreme Court in this regard. The Regular & Adhoc promotion to DE cadre is held up since August 2011 due to the quashing of seniority lists 6 & 7 by the Hon CAT, Mumbai Bench as SC/ST candidates are available only in list no 6 & 7. The appeal in the Hon High Court of Kerala on the same matter is reserved for judgment. The appeal in the Hon High Court of Punjab & Haryana is also pending.

President and FS attended the meeting. Management was not able to solve any of the issue for which notice has been given.

12.12.2011: Hon'ble CENTRAL ADMINISTRATIVE TRIBUNAL, ERNAKULAM BENCH O.A. NO. 109 OF 2011 with O.A. No. 110/2011 and 236/2011 judgment dated 07.12.2011 in the Seniors (SDEs promoted as adhoc DEs before getting the second TBP ) getting less pay than Juniors ( SDEs promoted as adhoc DEs after getting the second Time Bound Promotion ) case : " The respondents are directed to step up the pay of the applicants to the level of pay of their juniors with effect from the date of arising of the anomaly of seniors drawing less pay than their juniors in respect of each of the applicants within a period of 3 months from the date of receipt of a copy of this order. However, this order will not stand in the way of the Committee set up to deal with the issue under consideration in these O.As, giving a more beneficial recommendation for the applicants."

This issue is under active consideration with the Committee headed by PGM ( Finance), CO, New Delhi. 8.12.2011: Congratulations, Continues efforts of AIBSNLEA yielded the result in getting released order for calculation of monthly contribution based on existing basic pay instead of maximum of pay scale w.ef. 01.12.2011.(AIBSNLEA Letters dated 14.06.2010, 9.2.2010, 25.03.2010 and 18.10.2010).

08.12.2011: On AIBSNELA and BSNL Management continues persuasion, Government finally decided to refund around Rs.7000 crores towards obsolete BWA spectrum charges to BSNL.

08.12.2011: GS, President, FS, AGS(HQ), AGS(F) met PGM(FP) and discussed:-

(i) DPCs from JAO to AO and AO to CAO(Adhoc/Regular): We expressed our serious concern against delay in holding DPC from JAO to AO and AO to CAO(Adhoc/Regular). PGM(FP) mentioned that for holding DPCs to fill up about 487 CAOs posts on adhoc basis and about 230 CAOs posts on regular basis have been sent to BSNL Management Committee for approval. He assured that in the next MC Meeting, he will get clearance from MC and DPCs will start. Similarly DPC to fill up about 476 vacant AOs posts has been initiated, the ACRs will shortly be collected.

(ii) DPC from CAO to DGM(F): PGM(FP) mentioned that the Lucknow Bench of SC/ST Commission has restricted the DPC till their clearance. Efforts are being made to get clearance.

(iii) Request/Modification Transfer cases of AOs/CAOs: We requested for consideration of pending request /modification transfer cases of AOs/CAOs. PGM(FP) assured to look into.

(iv) Holding of Committee Meetings on withdrawal of clarification issued by Pers. Cell dated 19.02.2010(AAO/Sr. AO/Sr. SDE Cases) and Senior executives drawing less pay than their juniors:PGM(FP) mentioned that tomorrow itself committee will hold the meeting on clarification issued by Pers. Cell dated 19.02.2010 (AAO/Sr. AO/Sr. SDE Cases). For other issues committee will hold the meeting shortly.

21.09.2011: JAC decides to observe one day mass fast on 27-09-2011 and one day strike on 10-10-2011 :The JAC which met at New Delhi today 21-09-2011, took the historic decision to oppose the VRS, lock stock and barrel. The meeting which was presided over by Com. G.L.Jogi, GS,SNEA(I) , unanimously decided to observe one day mass fast at All India level, circle level and SSA level on 27-09-2011 and to go on one day strike on 10-10-2011, opposing VRS, demanding PLI, etc. President , FS and AGS(HQ), AIBSNLEA attended the meeting along with the other unions /associations i.e. BSNLEU, SNEA(I), BSNL MS, TEPU, SEWA BSNL, BTU and NFTBE.

Policy related issues include:-

Compensation for BSNL's rural operations.
Pension contribution on actual basic pay.
Refund of RS.8313 crore to BSNL, which was paid towards BWA spectrum charges.
Reimbursement of License Fee.
Allowing BSNL to surrender 3G spectrum of unviable circles.( Private companies are given the freedom to select circles of their choice.)
Refund of Rs. 7500 crore with interest, collected from BSNL towards "Notional Loan."
Procurement of equipments.

SUB:-Regarding promotion of eligible SDEs to DET officiating.

Most respectfully it is hereby requested that there is an acute shortage of DETs In Haryana Circle.So almost all the DETs have been allotted more than one charges.Consequently they all are overburdened and not able to control all the sections efficiently and effectively which is harmful for BSNL in this era of tough competition.Overloading is also causing resentment amongst the DETs.The main reason behind the shortage of DETS is large no of retirements and non promotion of eligible SDEs for last two years on officiating basis while all the other Cadres are being promoted and SDEs are being kept deprived of their legitimate right of promotion.So resentment is prevailing amongst our comrades both in SDEs and DEs cadres, former being deprived of their legitimate right of promotion and later being overloaded .

So you are requested to promote the eligible SDEs to DETs on local officiating basis so as to prevent resentment amonst the officers and to have a better and efficient control.In this regard it is also worth to mention that almost all the circles are giving the officiating promotion on the existing seniority list.Moreover the officiating arrangement is a temporary arrangement and can be terminated at any time.The directions of supreme court regarding contempt proceedings are also attached h/w for your kind reference please.

Minutes of meeting held on 21 JUNE 2011 with Honourable CGMT Haryana

Circle Secretary , President and Financial Secy met Chief General Manager Haryana,Sr GM Admn,Sr GM (Fin) on 21/6/2011 in the chamber of CGMT Haryana . Meeting took place in a co-ordial atmosphere ,we assured our fullest cooperation to CGMT Haryana.The following points were discussed in the meeting :-

1 Non commissioning of wimax BTS :-

CGMT Haryana directed the vendors on spot to complete the pending points at earliest so that BTS may be commissioned as soon as possible.

2 FTTH:-

We expressed our concern on expenditure of Rs1100 cr for purchasing the FTTH eqpt where the output is almost negligible.So further fibre should not be laid without having demand.CGMTHaryana appreciated our concern and assured positive action in this regard.

3 Problem in CDR :-

We apprised CGMT Haryana about slow speed and other problems of CDR system. Mr Maninder Bhatia circle nodal officer told us in detail that case has already been taken up with M/s TCS and action is being taken to remove the CDR problems.

4 Scarcity of new telephone instruments ,cables and other items:-

CGMT Haryana told that 1400 Km 5pair has already been allotted to SSAs and PO for telephone instruments will be issued soon.

5 Pooling of Vehicles:-

Sr GM Admn told that instructions have already been issued and being followed.

6 Auction of trunk lines and other obsolete materials:-

CGMT Haryana replied that obsolete materials are being scrapped from time to time. Some poles are standing for the purpose of ADvt. as per directions of CHQ.

7 Curbing of Wasteful expenditure such as Rent and Elecricity Bills being paid for the sites where no BTS is installed/cancelled and closure of loss making exchanges etc:- CGMT Haryana told that decision will be taken after discussion with worthy CMD.

8 Permanent Posting of DGM at Panipat:-

CGMT Haryana replied that at present there is shortage of DGM in Haryana. DGM Panipat will posted on availability.

9 Deployment of more staff in pursuit cell and allotment of vehicle on regular basis :-

Sr GM admn told that the suitable instructions will be issued soon.

10 New 3G BTS may commissioned only after confirmation from SDE CM concerned to have proper Utilization and good revenue generation and avoid unnecessary expenditure:-

CGMT Haryana told that Instructions will be issued soon.

11 Officiating arrangement in the Cadre of DE and PS and look after arrangement in the cadre of DGM (Fin):-

CGMT Haryana told that DE officiating orders are not being issued on account of court case.But legal opinion will be taken in the presence of Association representatives and it will be decided on the base of legal opinion.

12 Relieving orders of Sh HS verma SDE Samalkha ,Sh R.K Shrama DE Panipat,and Sh Chander Prakash Mehta SDE gurgaon for Chq and transfer of Sh S N Duhan DGM HSR.:-

Sr GM Admn informed that the case of all JTOs/SDEs/DETs/ has been sent to CO for proper substitute /cancellation.Officers will be relieved as soon as proper substitute is available.Sr GM Fin assured for early transfer of Sh S N Duhan DGM fin Hissar.

13 Transfer should be done on seniority and request basis and not on pick and choose to avoid heavy expenditure on TA/TP :-

CGMT Haryana assured to issue the instruction to the concerned officers.

14 Poor performance of HBL make batteries .So these should not be procured:-CGMT Haryana told instructions have been issued to concerned officer.

15 Expedite the work of the leasing out infra to other operators and early implementation of installation of ATM in Xge building and leasing out 3G network to other operators for roaming:-

CGMT Haryana assured for positive action regading to leasing out infra and early implementation of installation of ATMs in Xge premises and regarding leasing out 3G network he told that it is CHq level matter.

16 Leasing out of vacant quarters and prime locations for additional revenue generation:-

CGMT Haryana informed that action is being taken in this regard.

Observing of "Employees Awareness Week"

The JAC has decided that an "Employees Awareness Week" is to be observed from 18^th to 24^th April, 2011. During this period, combined General Body meetings of all the JAC affiliates are to be conducted at the Branch and SSA levels. In these meetings, the SSA / Branch level issues on which action is to be taken i.e., to increase the quality of services as well as customer satisfaction, will be identified. Together with this, action programme are also to be formulated to achieve the objectives, i.e. improving the quality of our services and customer satisfaction.

Observing of "Customer Delight Month"

A Customer Delight Month is to be observed by the JAC, from 1^st May to 31^st May. The following targets are to be achieved during the month of Customer Delight Month.

� Zero land line, OFC faults () All faults to be cleared on the same day

� Zero Broad Band faults () Cable faults to be cleared within 48 hours

� Zero Leased line faults

� Zero BTS faults

� Zero pending work orders of New Connections / Broad Band / shifting

� Redressal of customer grievances in respect of quality of service, billing,

stopping migration of customers.

� Visiting subscriber premises. Make the customers to learn using GPRs, through

demonstration. This will enable the customers to avail value added services.

� Proper upkeep of the batteries and power plant.

� Identifying / disposing of scrap materials.

� Effective utilisation of the space which had been occupied by scrap materials.

� Maintaining punctuality - attending office on time.

� Manning of the Customer Service Centres from 8 am to 8 pm and on second

Saturdays & Sundays.

� Giving proper publicity by issuing pamphlets to the public, displaying posters /

flex boards and publicity through media. This is to give a message to the public

that BSNL employees care for their customers.

� Each employee should bring at least 2 new customers (land line, Broad Band /

Mobile etc.) during this month.

� To take all measures to save electricity.

� Weekly Review of the progress and discussion between management & staff side.

CS and OS(Engg) met CGMT Haryana on 17/3/2011 and discussed following agenda containing few suggestions for the financial viability of BSNL and improvement of BSNL services.CGMT Haryana appreciated the suggestions

and assured for the early settlement of all the issues:-

Agenda for Meeting:-

(1) Non commissioning of wimax BTS sites

(2) FTTH Utilization:- About 1100 crs. GEPON equipment has been purchased by BSNL and lying un-utilized in absence of proper planning for the use of these equipments. Before purchasing these equipments, no market potential has been studied.

(3) Problems in the CDR billing system .

(4) Scarcity of new telephone instruments, Cables and other items in the field units .

(5)Pooling of Vehicles to avoid misuse and pooling of infra and housekeeping units in the adjoining offices on the same floor.

(6) Auction of trunk lines and other obsolete materials.

(7) Curbing of wasteful expenditures Viz; such as Rent and Electricity bills which are being paid for some sites where no BTS is installed/cancelled& closure of loss making exchanges & Closure of multi xges in the same city wherever possible to avoid huge expenditure on operation and mtce and security etc.

(8) PERMANENT POSTING OF DGM AT PANIPAT

(9) Deployment of more staff in pursuit cell and allotment of vehicle on regular basis to expedite and maximize the recovery from defaulters

(10) New 3G BTS sites may be commissioned only after confirmation of actual reqirement from SDE concerned to have proper utilization and good revenue generation and avoid unnecessary expenditure.

(11) Officiating arrangement in the cadre of DE and PS and look after arrangement in the cadre of DGM(FIN)

(12) Relieving of Sh H.S.Verma SDE SAA and Sh R.K.Sharma DE(TX & CM) Panipat and Sh Chander Prakash Mehta SDE Gurgaon and transfer of Sh S N Duhan DGM HSR.

(12)Transfer should be done only on seniority basis and not on pick and choose method.Moreover transfers should be done on the request basis and not in the interest of service to avoid heavy expenditure on transfer TA/TP.

(13) Poor performance of HBL make batteries.So these should not be procured.
